NYS Attorney General Real Estate Opinions and other random musings...
When I go on lock down I usually turn my phone off but Stacey is helping me with my license upgrade so I have to stay live until midnight.
My chauffeur's license is a Class E so if you hop over here http://www.nydmv.state.ny.us/ you'll find the official website of the NYSDMV and this page http://www.nydmv.state.ny.us/broch/cdlmanual.htm will give you the entire commercial manual in PDF (I like free books).
I am procrastinating on the NYSDMV site because I want an enhanced driver's license. That's on this page if you are a New York resident who wants to drive to Canada and Mexico then return to the US using an upgraded WHTI-Compliant Enhanced Driver License (EDL). Since I don't have a passport, getting this will allow me to check out the Canadian side of Niagara Falls. That bit of eye candy is on my bucket list... so is the Toronto Film Festival (LOL). ;-)
That bit of driving license random musing was me taking a break from studying the NYS Attorney General's informal and formal real estate opinions...
If you want to become a sales agent, an associate broker and/or broker owner in New York State you really should learn to keep up with this website. The AG opinions are cool little memos with reference points as to why we can and can not do what we do and don't do.
Those memorandums also whack some of the unsubstantiated allegations you might have seen bouncing back and forth in forums when people take their personal opinions and try to shove them down your virtual throat as "facts."
When I have a question I like to ask my out of state friends because they are very generous about mentoring me (and giving me a virtual slap upside the head when I need one - LOL). Their answers usually lead me to searching specific parts of the law I may not have realized I needed to look at.
Since we are texting and chatting live I figured I would share some of the NYSAG links we are talking about because it's interesting to compare and contrast the differences between the states and local markets.
NYS Attorney General on standards for preparation of contracts by real estate brokers is a good PDF to know:
NYS Attorney General on the 1993 amendments to the Real Property Law imposing a twenty year limit on priority of liens of credit line mortgages not being applicable to reverse mortgages (I learned something new today - did not know that little tidbit - LOL)
Here is the numerical index from 1995 to 2011. Go poke around and learn something new. It's a minute until midnight. Gotta go. ;-)
