Real Estate Applicants For A Loan Or Forbearance May Want To Get Their Consumer Reports

Sometimes people e-mail me the most interesting questions. If it is interesting enough I will answer my e-mail in public. I am a paralegal not an attorney so I do not give legal advice but I can share common knowledge.

Today, I shall share two points of order and will make no opinions regarding the quotes. BTW, these little snippets of New York state  information can be found on government websites (if you care to look for it) and I am simply going to provide two quotes from here.

I love quoting the government. It makes my life easy. If you repeat the government it's pretty hard to mess the info up. What you each decide to do with it is completely up to you. :-)

Now that we have all of that out of the way, lets get to the government quotes. Ready? Read:

" § 254-c. Right to a copy of real property appraisals and consumer reports in certain cases. 1. Any lender who requires an applicant for a loan or forbearance, which is to be secured primarily by an interest in real property, to bear the cost of either an appraisal of said property or the cost of obtaining a consumer report subject to the provisions of article twenty-five of the general business law as a condition to the processing of the application or the granting of the loan or forbearance, shall, upon the written request of such applicant, provide to him a copy of said appraisal or consumer report as the case may be, at no additional cost."

" 2. "Lender" as used in this section shall mean and include any bank, trust company, national bank, savings bank, federal mutual savings bank, savings and loan association, federal savings and loan association, private banker, credit union, federal credit union, investment company, insurance company, pension fund, mortgage banker or any other entity."

Don't Let a Short Sale Agent Hold Your Offer in Back-Up Position -- Report Them

presentation of short sale offersEither some listing agents are unaware of their fiduciary responsibility to their sellers or they don't read the REALTOR® Code of Ethics, because many agents are violating both. It is absolutely a misnomer that a Sacramento short sale agent can refuse to send a buyer's offer to the seller(s).

I know this practice is more wide spread than my personal experience has shown because I get asked the same question from other agents who ask to write offers on my Sacramento short sale listings. They say every short sale agent handles it differently. They ask me if I am sending all offers to the bank or if I have sent the first offer and am holding the others in back-up. Because that's how many naive agents handle short sales.

They are wrong. Dead wrong. Nobody died and made those agents God of all short sales. Are they lazy? Is that the reason? Incompetent? Is the first offer their own buyer? I don't understand it and don't need to understand it.

A short sale listing agent must submit each and every offer to the seller unless the seller notifies that agent in writing to cease.

Here is an excerpt of the National Association of REALTOR® Code of Ethics:

Standard of Practice 1-6           
REALTORS® shall submit offers and counter-offers objectively and as quickly as possible. (Adopted 1/93, Amended 1/95)
Standard of Practice 1-7
When acting as listing brokers, REALTORS® shall continue to submit to the seller/landlord all offers and counter-offers until closing or execution of a lease unless the seller/landlord has waived this obligation in writing.

While it is true that some lenders, Countrywide, for example, won't look at competing offers once it's begun a file on an offer, other banks will. Regardless, an agent must submit all offers.

The next agent I catch in writing telling me that she won't submit my buyer's short sale offer will find herself answering to the Sacramento Board of REALTORS®. I encourage other REALTORS® to report these offenders as well. If we don't come together as a group and put a stop to this nonsense, our profession will continue to suffer from such antics.

My Dear, Sweet Friends (Sitting Shiva)

My lovely and dear, dear friends: THANK YOU ONE AND ALL. I've never lost a parent before and when my hubby's Mom passed away yesterday I was undone. It feels different from any other death and grief I have ever experienced... Please keep us in your prayers. We're going to need all the help we can get. We're looking for emotional outlets right now.

Got a Wiki quote for you: "In Judaism, shiva (or shiv'ah, Hebrew: שבעה ; "seven") is the week-long period of grief and mourning for the seven first-degree relatives: father, mother, son, daughter, brother, sister, and spouse. (Grandparents and grandchildren are not included). As most regular activity is interrupted, the process of following the shiva ritual is referred to as "sitting shiva." Shiva is a part of the customs for bereavement in Judaism."

This is what we will be doing. I just don't know if in NY or FL yet. Hubby has to decide... I've passed on two listings and am shifting a contract signing. I've a closing on Friday and a walk through today. I'm on a mission to get the rest of my buyer's brokerage agreements completed because the family is date squabbling again. What else is new, eh? (LOL) Geez... I guess grief brings out the best and worst in us at the same time.

Time for some blog post therapy:

I am very angry. I'm am desperately trying to keep my b*tch switch under control because we are all grieving. It is hard to do what must be done when the loss is so profound. It is hard to come to terms with the fact that I will not be having another conversation. She e-mailed every single month and never missed making contact... She called constantly to say hello. She appreciated every single photograph and story regarding her darling little minions. This sudden silence brings with it an unexpected void and the grief of not knowing her last thought is killing me. We had something we each wanted to say and the theft of that conversation is an emotional obsession that leaves me undone. I can not breathe well. My throat is tight and the tears have me typing blind at my keyboard. Everything has changed. I am now afraid. I don't know where to go with my emotions... I have never felt this way before... I am in a rage. Death has robbed me of a beautiful relationship...

My Mom-In-Law was well loved and it is going to be hard to deal with life without her influence on the family. In case you haven't noticed, I can be pretty plain spoken, so I have some regrets in that regard and I am dealing with my personal anger one issue at a time. I must confess I am not dealing with it well. I hope you will forgive me for the long post. I don't know how to deal with my emotions right now because I am tormented with the fact that my kids and hubby were robbed as well and his Mom was someone we all needed in our lives. We are all taking this very hard but I am trying to cope, so I sit here having blog therapy writing the first thoughts that come along wondering if Wordy C will show up an make me laugh at some point  since the cartoons in my head are somber and in mourning. I've lived a pretty fascinating life, my life is not over but something precious has ended. Relationships are precious and fragile and you don't know how the loss of someone in your life will affect you until you suffer that loss.

I would rather focus on the good stuff. I want to embrace the good memories. I want to hold on to every kindness she has ever shown. I am going to do what I do best and work this out one thought at a time while I talk with you and wonder where to go to pick up the pieces of my shattered emotions. It's going to take a while because we are really hurting over here and one does not know what one has lost until it is gone. She is gone and I am undone... My heart is crying... I have to go...

I will be writing a bye to mom post later. Sorting through the family pictures and arranging new music for a photo-montage should keep me busy for a while. Blog therapy with my family and friends is nice. I do feel a little bit better. When I drop my kids at school I am going for a jog. I could use a good laugh to kill the waterworks so I may head to Brooklyn to film where we used to hang out by the water. Me and the wee ones did have a lot of fun visiting up and down the shoreline and spoofing at her home in FL. I'll collect some shots and show you. I just wish we had more time... I ran out of time on Friday the 13th. 

Everything changed on Friday the 13th. I will never forget that day as long as I live. It was a bad day for me in more ways than one... I want to have good days. I keep thinking that though. I want my life back. Can't have the old one. That's done. I want a new one. One that doesn't feel the way I feel today. Virtual shiva is kinda nice... I've got just the thought to share.  You're about to learn something new about us later on today when I share some of my fondest thoughts and silly memories of being a part of my Mom-In-Law's life.

I will be sitting shiva at Club Chaos. I need my virtual family just as much as my brick and mortar. You are all a very special part of my life and I really do love my bay-bays so I publicly apologize to everyone that I have ever hurt, harmed or inadvertently disregarded and humbly ask that you please forgive me. I have to start over because everything has changed and I do not want to miss any more important moments with the people that I care about if I can help it.

My relationships are a very important part of my life. I do not want to squander them... If you have something to say to the people you love you should say it and not hesitate. Sometimes, when the moment is lost, it is lost forever.

Rules For the Control of The Tongue

The Code Of Ethics and Standards Of Practice.

A recent conversation between myself and Randy Hooker brought up some interesting thoughts on the National Association of Realtor®'s Code Of Ethics.  For those of you unfamiliar with the Code (as we call it, also referred to as the COE), it is basically a set of guidelines to help determine our duties to clients and customers, the public, and other Realtors®.  Within the code, we are taught to apply these ethics to our daily practice of real estate and it also sets forth a system to deal with those that break the Code.

I love the fact that the National Association of Realtors® has put forth this set of 17 Articles in order to help define our business and I take the idea of ethics quite seriously as in this business, as with many others, there is always a potential for unethical actions that could bring harm to the consumer as well as our industry as a whole.

The responsibility of a Realtor®.

Randy and I were talking about the responsibilities of being an agent and best serving our clients.  We were discussing Trulia Voices and bank foreclosures.  Trulia Voices is a great idea, if you've not used it before its pretty simple - people post questions and people answer them.  Typically its consumers asking questions and agents responding, but sometimes it works the other way around.  There has been a lot of debate over the value of Trulia Voices and the potential problems it brings.  As for bank foreclosures, we both agreed that the current state of them in the MLS is unacceptable and its a shame the banks don't care much or know about it.  These foreclosed properties are lucky to get one photo and a line description.  Without showcasing the property, the bank is losing out on potential buyers (in our opinion).  We both wished there were good solutions to the problems.

Of course, the simplest solution would be for Randy and I to rule the world and list all these properties and answer all the questions on Trulia Voices (no offense to all you other great agents out there, but it was Randy and I talking, so we took it upon ourselves to rule the world).  Of course, that's not going to happen and in reality, there are plenty of excellent agents out there who could join our team.  But there are plenty that couldn't join.  They're just no good.  Yep, I said it - there are Realtors® out there that are no good.  They're bad at their jobs, they do a disservice to their clients, they flirt with legal disaster, and they give the rest of us a bad name.  I'm not talking about the ones who slip up here or there - people make mistakes.  The ones who do it consistently time and time again - those were the targets of our ire.

I wish I could paint a rosy picture for you and tell you all Realtors® are perfect and do everything in their client's best interest, but that would make me a liar.  Because of my own ethical code, I wouldn't want to do that.  So, yes, there are bad Realtors® out there.  I don't have some magic list, but in some ways, I wish I did.  The problem with our own Code Of Ethics is that it protects us against each other.  Ever wonder why Realtors® always ask, "Are you working with a Realtor®?"  Its because we're afraid you might have a contractual agency-relationship with another agent and we could get in big trouble for getting in the way of that relationship. 

So how does the Code Of Ethics create a problem?

Article 15 of the Code Of Ethics deals with how we relate to other Realtors®.  Its basic tenet is that we shouldn't "trash talk" other agents (I'm putting it simply there).  In making this Article, my guess is that the National Association Of Realtors was attempting to stop agents from saying things about other agents in order to gain business (ie, "Oh him?  He smokes crack," "You're working with who?  They ripped off their last client," or "That agent?  I heard he eats babies and runs a small-time meth lab out of his office.")  Obviously, this type of business practice is idiotic and not-so-ethical, but things like these happen everyday in all types of businesses.  Competitors trying to run the other into the ground through rumor, false statement, and misleading comments.  Its not the way I would choose to run my business, but there are those that would (ie, politicians).

The problem arises when you want to "call someone out" for what they're doing that isn't in the best interest of the client or the public.  I know a lot of people keep the "if you don't have something nice to say, don't say it at all" idealism going in real estate, but the fact is - if someone's giving a client sub-par service than that consumer deserves to know.  Of course, this brings up a conundrum - whose idea of "best interest" is right.  Because of this little snag, its next to impossible to get around the Code and "call someone out" for their actions (or more typically, their lack of them).  So at the end of the day, those of us who want the world to get the best from real estate and improve the client's experience (and perception of the industry) just have to lead by example and do our best as trying to correct the situation (via open discussion with the client about their agent) really isn't within our reach.

I love real estate, but (and I've stated this before) we sometimes get a bit touchy about the subject of ethics and what to do about the agent who's giving us all a bad name.  I've seen many posts here on ActiveRain revolving around "taking the high road" or "best not to air our (Realtors®) dirty laundry in public" and I have to politely disagree.  If this industry is to move forward and adapt to work with a changing society, then we need to discuss things openly and honestly - with the public involved.  Locking out the public, just creates a secret society that will fuel the images of corruption and greed within the consumer's mind.  It does us no good to not involve the public in our growth as they are the people we serve (I sound like I should be running for City Council) and without them, we're a huge number of our of jobless people with useless licenses.

Standard of Practice 15-1

REALTORS® shall not knowingly or recklessly file false or unfounded ethics complaints. (Adopted 1/00)

Standard of Practice 15-2

The obligation to refrain from making false or misleading statements about competitors’ businesses and competitors’ business practices includes the duty to not knowingly or recklessly repeat, retransmit, or republish false or misleading statements made by others. This duty applies whether false or misleading statements are repeated in person, in writing, by technological means (e.g., the Internet), or by any other means. (Adopted 1/07)

Sheldon, are you related?

It's official, I heart Marcus Brown. I have never seen someone read Twitters Tweets like a poetry reading in the bathroom. Yup. Not a typo. Dude is too funny and very unique. I love unique personalities and have to give kudos and congrats where it is due. Anyone who can pull off a good bathroom scene deserves a shout out. Seriously! He makes you wonder what they hell he's going to do in there. I had to watch it. It started with the hair. I was wondering if that was deliberate or not. Then I started wondering who cleaned the bathroom. This took preparation... It's a great shot. He even has a British accent, so of course I immediately started thinking about Poppy D and Sheldon N. I fell out LAUGHING after that because all I kept thinking was what would Poppy and Sheldon say... Hmm... something dry and pithy of course! ;-)

First person I had a great laugh with was Melodious. I kept her on the phone for hours. So now all of the cartoons in my head will not stop chatting in the Queen's English while quipping inappropriate remarks waiting to find out what the rest of my friends think of this video.

Yup. It's true. I'm sharing it. After all, Lani from AgentGenius.com shared it with me (thank you, girlfriend!). Gotta spread the link love. Besides, it's true. On rare occasions I actually enjoy sharing toilet humor (LOL). Ooooo - learned something new about me today, eh?

Hmm... Maybe... maybe not.

Okay - I take that back. You really didn't learn anything new about me today. Seriously. Don't believe me? Um... I can prove it. Oh PUH-leeze! How could you NOT know? Must I recount the electronic adventures of Stephen, the Minion Blur with my scientific notation calculators? We will not speak of the cell phones in the toaster or the fact that play-dough and microwave should NOT be used in the same sentence (LOL). Our cell phones have floated in our bowls, not to mention took a few dives out of the window, so yeah, I get toilet training and toilet humor.

BTW, you can thank Susan Mangigian for the play-dough line. I still laugh when I recount that particular conversation. What a fantastic Mommy podcast that would have made (LMAO). Maybe we should add that to our Thelma and Louise tours of PA...

Picture this: Mangiggly, the I-talian schools Wordy C on Minion Parenting. We will have to insert the appropriate minion clips of course. I have very interesting footage of minions-gone-wild you have yet to see. Sue is gonna have a lot to analyze (LOL). Video and podcast coming to a blogpost near you (LMAO).

Awwww... I can't stop laughing when I think about it. My minion imagination refuses to behave. While I fool around with plotting and planning that bit of audio/visual fun I'm off to go dig up the other videos this guy has made. :-)

BTW, Marcus did a really nice job on this brief video, so go check him out after you get over the fact he's talking to you from the throne. :-)

P.S. You guys better hope this dude never decides to read some of you (after all, I am your tweet-peep, I know what you've said). Think about it (LOL). This is his 12th reading! I've got to find the other links. I confess I am now a new fan of his humor. It's a quirk I'm looking forward to indulging in. I may have to add "All Things British" to go with the hollish, wacked and jack line (LOL).

Selling in Today's MarketEven though now doesn’t seem to be the ideal time to sell your home if you can hold out, but if you must, you can take heart in knowing that small actions may make a difference in getting your home sold.

Scentmosphere isn’t exactly new but it is rapidly becoming a way to attempt to attract buyers.
So, right now take a deep breath. What kind of smellment is your home making?

Choosing to make a positive statement in the way your home smells is just another step in helping to sell your home faster. It’s the next step after curb appeal. Curb appeal gets buyers in the door but then they see and smell your home and begin to decide if this is the home for them. If it’s a vacant home it can be musty. But if it’s an active home it also could have odors of whatever activities that are going on in house.

Are buyers going to smell the over-sized dog that walks around the house after rolling in the newly-cut grass? Are they going to smell your son’s gym bag filled with dirty socks that has been buried deep in his closet for the last five weeks? While we certainly don’t all have the same preferences for scents, most would agree neither of those two things pose a welcoming aroma.

Candle fragrances such as the smell of freshly-baked cookies. Although not everybody likes to eat cookies but everybody enjoys the smell of cookies, and when I say everybody, there may be the exception here or there, but the vast majority would enjoy the baking smell. So we’re always fond of fragrances that are in the vanilla family.

Fragrances such as French vanilla, butter cream, and créme brûleé that mimic baking scents are welcoming and inviting for buyers. Scents register in our brain and frequently remind us of our past experiences. Creating pleasant aromas in your home can help the buyer to experience an emotional connection with the home.

When it comes to bathrooms, great rooms, or even basements it’s a good idea to try different fragrances. You may want to think of what we refer to as clean or fresh fragrances and those could be based in various fruits, so the citrus family is a really good one. However, there are some fragrances that you should avoid as they don’t tend to appeal to the masses or they have too strong an odor.

Sellers should use fragrances that will instantly be winners such as vanilla, kitchen spice fragrances, citrus, and the smell of freshly cleaned laundry.

With all the tips out there about selling a home, the scent factor is often the most forgotten.  If you don’t have a scent that you want in there, buyers are going to smell whatever is going on in that room. So if it’s been closed up or doesn’t have a lot of air flow, there will be more of a musty, damp, or a less desirable scent.  It just makes sense that if you want to create an appealing environment for buyers, pleasing scents should be part of the selling plan.

Other ForeclosuresIt’s a situation facing hundreds upon thousands of people and the numbers are growing rapidly. Foreclosures aren’t just happening to people who have over spent and got into risky loans. They are happening to homeowners who are getting divorced, facing health issues, needing to relocate for a job, and numerous other reasons. Regardless of how you may end up falling behind on your mortgage, knowing what to do next is critically important.

A lot of the news media is talking about the first thing you need to do is contact your lender. However, if homeowners who are facing foreclosures contact their lender first, the first person they interact with is the customer service agent who may threaten them and tell them that they are going to foreclose on your home right away to scare them into not taking action. If they get to a loan mitigation person and they are talking to them, they may agree to a workout that they cannot afford just to get the phone calls to stop. However, if they agree to a workout they cannot afford and they miss a payment, homeowners have essentially lied to their loan agency and that’s not something good.

What people are finding is that lenders are willing to work with them. It will take a whole lot of persistence on the part of homeowners. They really need to make sure that they’re not intimidated by the conversation they need to have with their lender but they need to step up and say ‘I am not going to be able to make this. What can we do to suspend the payment or lessen the payment or modify the payment until I get back on my feet?

In case you just need a little bit of extra money to get caught up, there are some employers who have a five-thousand-dollar loan that they are able to give their employees with low interest. They can pay it back through their pay over time; that’s one. Two, there are grant programs through housing counselors like HUD; there are grant programs that are available to people who are going through foreclosure.

Due to the housing crisis, A lot of people are taking in boarders and renting out rooms. Some people are renting out their entire house and they are staying with family so that they can make the mortgage payment. These are all things that homeowners need to do—think a little bit outside of the box when it comes to a solution. Another thing is, with the gas prices being as high as they are and people having to commute back and forth to work, you may want to ask your employer if you can cut down to a telecommuting schedule and think about selling your car.

Looking for solutions to an emotionally and financially draining situation such as a foreclosure is fatiguing and frustrating. However, if you realize there are options then you can begin to build momentum to rectify your situation. Ultimately, it’s critical to consult with experts on this matter, to be open about your financial dilemma, and to seek help immediately. Real estate agents can either help you sell your home in a short sale, if necessary, or rent it out to help you pay your mortgage. Trying to do it alone can be a painfully disastrous experience — seek the help you need.

People ponder a lot of things and I have to say she made enough pithy comments that I'm still smiling over the fact that I can't figure out which one is my favorite quote (LMAO). Go read her post. Seriously! Betcha' she makes you pause and think about what you may or may not be doing with your blog post. :-)

I have been arranging music and hanging around lower Manhattan randomly catching images. I have a couple of paintings I need to do, so I thought the ships would be a nice subject to capture. I always love sketching the Brooklyn Bridge. Music and art always makes me happy. I've had a lot on my mind lately, so I'm trying to take a break and play with my toys. I'm working on an attitude adjustment. This may take a while... I'll probably be creating some interesting stuff while I have a little blog therapy with my friends...

Bernard B. Kerik, well done, sir!

BBK posted a Facebook link to an article that he wrote entitled, "No More Lip Service on Darfur." You ever have a plain spoken man say something that made so much sense you had to stop and wonder why more people are not saying this?

You guys know how much I love my recreational reading. His words actually made me stop and think. It is my pleasure to share this article with you and I believe it's worth a mention to your social media peeps. If you like it, please pass the link along. Our President could use all the help he can get with this situation because something certainly must be done and done quickly. Nothing like a little social media buzz to get the conversation flowing...

Read Mr. Kerik's article and think about it... We write blog posts every day, from the silly to serious, on and off topic, rants, raves, the sublime and the insane. Where do you want to go with your writing or what do you want to do with your virtual space today? His post certainly moved me enough to share the link and give up some cyber-real estate.
